Acceptance of Terms
(a) PitchSpace Social Inc. (“PitchSpace”) provides this platform and related services (the “Service”) for business access under these Terms of Use (the “TOU”). Updates may be made at PitchSpace's discretion. The most current TOU can be accessed on the website.
(b) Arbitration Agreement and Waiver of Class Actions: The TOU requires binding arbitration for disputes, excluding class actions. Please refer to Section 21 for dispute resolution details.
(c) By registering or using the Service, you accept the TOU on behalf of your company. If you lack authority or disagree with these terms, you must not use the Service.
(d) Users must be at least 18 years old or have reached the legal age of majority.

Other Agreements and Terms
(a) Additional policies, including the Privacy Policy, are incorporated by reference into the TOU and are binding.
(b) Data transmission may require adaptation to technical requirements for network or device compatibility.

Registration and Account
(a) Registration may be required for certain features. You agree to provide accurate and current registration data.
(b) Account sharing is prohibited. You are responsible for activities under your account and must promptly report unauthorized use.

Fees and Taxes
(a) Access may involve fees, particularly for paid subscriptions. Your subscription will auto-renew unless canceled at least 24 hours before term expiration.
(b) For third-party payments, additional terms may apply.
(c) Taxes, excluding PitchSpace’s income taxes, are your responsibility.

External Materials and Third-Party Services
Links to third-party sites are provided for convenience. PitchSpace does not endorse these sites and disclaims liability for third-party content.

Grant of Rights
PitchSpace grants a limited, non-transferable license to use the Service as intended. This includes access to online software and mobile applications in executable form.

User Content Ownership
Users retain ownership of content. PitchSpace may use uploaded content to provide services and support.

Licensing and User Access
(a) Business users must obtain licenses for all employees accessing the Service.
(b) Monitoring may be performed to ensure licensing compliance.
(c) You are responsible for tracking the number of users under your account.

Code of Conduct
Users must refrain from illegal or disruptive activities, including spam, harassment, or copyright infringement.

Termination and Account Closure
PitchSpace may terminate accounts for TOU violations. Terminated accounts may result in data deletion.

Use of Third-Party Services
The platform may integrate third-party services. PitchSpace is not liable for these services and their terms.

Disclaimer of Warranties and Limitation of Liability
The Service is provided "as is." PitchSpace does not guarantee uninterrupted service and disclaims liability except as required by law.

Indemnification
You agree to indemnify PitchSpace against claims arising from your use of the Service.

Mediation and Arbitration for Dispute Resolution
(a) Arbitration covers disputes relating to the TOU and the services provided.
(b) Arbitration will be governed by AAA rules unless agreed otherwise.
(c) A single arbitrator will be used, unless complexity warrants three arbitrators.
(d) Arbitration will occur in New York, New York, and will be conducted in English.
(e) Decisions are final and binding, with limited grounds for appeal.

Governing Law
The TOU shall be governed by New York law. Legal proceedings will occur in Manhattan courts.

Children’s Privacy
PitchSpace is intended for businesses and not for use by individuals under 16 years of age.

Data Collection and Usage
Data is collected to provide and improve services. It is not used for individual marketing.

Data Retention
Data will be retained as needed for business purposes.

Updates to the TOU
Users will be notified of significant changes to the TOU.
